Terms of Service

1. Acceptance

By accessing or using Wisteria ("the Platform"), you agree to these Terms. If you are using the Platform on behalf of an organisation, you confirm you have authority to bind that organisation. The Platform is operated by 369 Sales Academy PLT (registration no. 202604000656 / LLP0045881-LGN), a limited liability partnership registered in Malaysia.

2. Description of Service

Wisteria is a corporate learning platform that enables organisations to create, deliver, and track training content. Features include AI-assisted content creation, quizzes, flashcards, in-person session management, certificates, and analytics.

3. AI-Generated Content

Some content on the Platform — including flashcards, quiz questions, and suggested training material — is generated or assisted by artificial intelligence. This content is provided for training purposes only. Wisteria does not guarantee its accuracy, completeness, or fitness for any particular purpose. Users should review AI-generated content before relying on it.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify your administrator immediately if you suspect unauthorised access. Where staff sign in using a phone number, your organisation is responsible for obtaining any consent required under applicable data protection law before providing those numbers.

5. Acceptable Use

You agree not to: (a) use the Platform for any unlawful purpose; (b) attempt to gain unauthorised access to any part of the Platform; (c) upload content that infringes third-party intellectual property rights; (d) upload special category or sensitive personal data into free-text content; or (e) interfere with the Platform's operation.

6. Intellectual Property

Wisteria and its licensors retain all rights in the Platform and its underlying technology. Content you create on the Platform remains yours, subject to the licence granted to Wisteria to operate the service.

7. Data and Privacy

Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. A Data Processing Agreement is available on request.

8. Limitation of Liability

To the extent permitted by law, Wisteria's liability for any claim arising out of or related to these Terms is limited to the fees paid by your organisation in the three months preceding the claim. Wisteria is not liable for indirect, incidental, or consequential damages.

9. Termination

Either party may terminate access to the Platform in accordance with the commercial agreement between your organisation and Wisteria. Upon termination, your data will be retained for 30 days before deletion unless you request earlier deletion.

10. Changes to These Terms

We may update these Terms from time to time. We will notify administrators of material changes. Continued use after the effective date constitutes acceptance.

11. Governing Law

These Terms are governed by the laws of Malaysia. Disputes shall be subject to the exclusive jurisdiction of the courts of Malaysia.
